The correct place to file Form I-589 depends on which agency has jurisdiction over the asylum application. USCIS generally handles affirmative applications outside removal proceedings; an immigration judge generally handles defensive claims in proceedings, subject to exceptions such as certain unaccompanied-child cases. [1]
Establish jurisdiction first
Check any notice to appear, court case status, prior proceedings, and relevant age or custody history. A scheduled USCIS appointment or an old address on a webpage does not override the actual jurisdiction rules.
Filing location and method can vary by case category. Follow the current official I-589 instructions and agency filing guidance rather than sending copies to both agencies and assuming one must accept them.
Protect the filing record
Asylum generally has a one-year filing deadline, with specified exceptions. Jurisdiction confusion does not automatically establish an exception. Preserve entry records, the complete signed application, delivery or electronic confirmation, and any rejection notice. [2]
If proceedings begin after an affirmative filing, determine how the existing application is transferred or renewed and what the court requires. Keep addresses updated with each relevant agency. A filing receipt is important, but it does not itself grant asylum or employment authorization.
Example: proceedings begin after an affirmative filing
A person who filed with USCIS may later receive immigration-court paperwork. The existing asylum application, any referral, and the court’s jurisdiction need to be reviewed together. Do not assume the person must start over with an entirely new narrative, or that the original USCIS filing excuses all court filing and attendance requirements.
Keep copies of the original application and supporting exhibits, notices showing when it was received, and every hearing notice. Inconsistencies between versions should be explained accurately rather than silently changing dates or events. The agency and court may require different submission methods or copies.
A person uncertain about whether a notice to appear was actually filed with the court should verify the case through official channels and obtain advice. Possession of a document and the commencement of a court case can involve distinct procedural facts. Timely asylum filing, venue, jurisdiction, and work-permit clock questions should each be tracked separately so solving one does not leave another deadline unattended.
A pending claim can lead to an asylum EAD request. A closed court case may require a motion to reopen before other relief is considered.
