Can You Work With an Incorrect EAD? Fixes and Proof

An error on an employment authorization document does not always mean the underlying work authorization disappeared. But it is unsafe to say every incorrect EAD can be used without concern. The type of error, actual authorization, validity dates, and Form I-9 documentation requirements all matter.

Identify whether the error is material

A minor spelling discrepancy presents a different question from the wrong person’s photograph, an incorrect category, or a validity period inconsistent with the approved benefit. Compare the card with the approval notice, application, passport, and other immigration records.

Some people are employment-authorized incident to status; others rely on an approved application under a particular category. The regulatory framework does not support the claim that everyone’s authorization comes solely from immigration status and never from an EAD approval. [1]

Use the correct correction process

USCIS’s typographic-error service request distinguishes an agency error from an error attributable to the applicant or a later change. Its instructions direct applicants to the document-correction process and explain that returning the incorrect document may be required. [2]

Keep copies of the card and supporting evidence before sending originals. Follow current instructions for the office, submission method, required form, and any fee. A correction request does not necessarily extend an expiring authorization.

Work authorization and acceptable evidence are separate

An employer must complete and, where required, reverify Form I-9 using acceptable evidence. A correction receipt is not automatically an unrestricted work permit. The employee may have another acceptable document or applicable receipt rule, but the actual requirements must be checked.

For example, correcting a misspelled surname does not ordinarily justify assuming fraud. A card showing another person’s identity requires immediate clarification and should not be presented as accurate evidence.

  • Document the error and the correct information.
  • Check the actual approval and authorization expiration.
  • Submit the proper correction request and retain confirmation.
  • Coordinate I-9 questions without misrepresenting the document.

See writing a USCIS correction request and adjustment-related employment authorization. If employment is about to begin or authorization expires soon, resolve the category and evidence questions promptly rather than relying on the plastic card’s appearance alone.
