Can You Get a Passport With Pending Criminal Charges?

Pending criminal charges do not create one automatic passport ban for every applicant. However, a felony warrant, a court order restricting departure, or another legal disqualification can support denial. Even when a passport is issued, it does not override bail conditions or give permission to enter another country. [1]

Check warrants and court restrictions separately

The passport regulation permits denial for an outstanding federal felony arrest warrant or an outstanding state or local felony warrant. It also addresses criminal court orders, probation conditions, and parole conditions forbidding departure from the United States when violation could result in a federal warrant. These are distinct grounds; the absence of one does not resolve the others. [1]

Read the actual release order before booking travel. A condition requiring passport surrender or judicial permission cannot be bypassed by obtaining a replacement passport. Ask defense counsel to identify the controlling order and, if appropriate, seek permission from the court before departure.

Some convictions have specific passport consequences

Federal law bars issuance during a defined period for certain drug-trafficking convictions involving use of a passport or crossing an international border in committing the offense. That is a specific statutory rule, not proof that every drug charge or every felony prevents issuance. The covered conviction, connection to international travel, and statutory period must all be examined. [2]

Other passport restrictions can arise from matters unrelated to the pending prosecution. For example, certified seriously delinquent federal tax debt has its own passport rules. Do not assume resolving the criminal case automatically clears a separate restriction. [3]

Make the application and travel plan accurate

  • Obtain the current release, probation, or parole order and any amendments.
  • Determine whether any warrant remains active.
  • Confirm whether the court requires surrender of an existing passport.
  • Answer passport application questions truthfully and use the proper application procedure.
  • Check the destination’s admission rules independently of U.S. passport eligibility.

If an application is denied, use the reason in the notice to identify the agency or court that must address the underlying problem. A passport office usually cannot dismiss a warrant or change a judge’s travel restriction.
