An outstanding warrant can prevent you from obtaining a U.S. passport, particularly if it is for a felony. The passport rules do not make every local warrant an automatic denial, but receiving a passport does not cancel a warrant or authorize travel prohibited by a court. [1]
Which warrants matter?
State Department regulations allow refusal when an applicant has an outstanding federal felony warrant or a state or local felony arrest warrant. They also address certain foreign warrants, extradition requests, military apprehension orders, and criminal court, probation, or parole conditions forbidding departure from the United States. [1]
A misdemeanor bench warrant requires closer examination. Its existence alone is different from a felony warrant covered by the regulation. However, associated release conditions, other charges, or a separate travel order can create additional problems. Read the actual court documents rather than relying on the label shown in an online search.
A passport and permission to travel are separate
The State Department explains that qualifying law-enforcement issues can lead to passport denial or revocation. Someone who already holds an unexpired passport should therefore check its legal status before using it. Possession of the booklet does not establish that it remains valid. [2]
For example, a defendant may have a passport but also a release order requiring the court’s permission to leave the state or country. The passport does not override that order. Conversely, clearing a warrant may not immediately remove a passport restriction until the responsible agencies receive the necessary documentation.
Prepare a documented resolution
- Obtain the warrant, case number, issuing court, and classification of the underlying charge.
- Review bail, probation, and parole conditions with defense counsel.
- Arrange a lawful way to address the warrant through the court.
- Keep certified records showing recall, dismissal, satisfaction, or modification of restrictions.
- If denied a passport, follow the notice’s stated review or reapplication procedure.
