How to Complete FSA-211: USDA Power of Attorney

Form FSA-211 authorizes another person or entity to act for you in specified USDA programs and transactions. It can permit binding agreements and create liability, so the selected powers matter. It is not a general power of attorney for every government or financial matter. [1][2]

Identify the parties and choose the authority

The grantor gives the authority; the grantee receives it as attorney-in-fact. Enter their names and the requested grantee address information accurately. For an entity, determine who has authority to grant the power rather than assuming any employee can sign. An FSA-211A continuation sheet may be needed when multiple required grantor signatures are involved. [2]

The revised form separates FSA and NRCS programs from the actions permitted for those programs. Preparing paperwork, signing agreements, changing banking information, and obtaining records are distinct selections. Select the programs and the related actions intentionally; checking a program alone does not explain every power you mean to give. [1][2]

Farm-specific limitations and records-only authority have their own provisions. Crop insurance under FCIC/RMA uses separate insured-crop and transaction selections. This form excludes FSA Farm Loan Program purposes and execution of NRCS easement deeds. Other business matters, including SBA loan forgiveness, require their own applicable authority and paperwork. [1][2]

Sign using the required procedure

The instructions require the grantor’s signature to be witnessed by an authorized Farm Production and Conservation employee or acknowledged by a notary. NRCS Conservation Easement Program use requires notarization; that special requirement should not be generalized to every NRCS program. Entity signers must show their representative capacity and authority. [2]

Use the current form supplied through USDA or the Service Center. Do not combine an old form’s item numbers with instructions for the revised form. Before signing, review the agreement and validity provisions as carefully as the checkboxes.

Submit the original and retain a record

The instructions call for the completed original in hard copy at the appropriate USDA Service Center; they do not accept faxed or electronic FSA-211 submissions. Confirm receipt and any additional crop-insurance submission requirements with the office or provider involved. Keep a complete copy. [2]

Limit or end the authority deliberately

The revised form permits a specified expiration date and otherwise identifies terminating events, including written revocation, death, and incompetence or incapacity. Deliver revocation through the stated channels rather than relying on a private conversation with the grantee. [1][2]

Accurate information and signatures remain essential. A power of attorney does not excuse false statements in federal program submissions.
