EB-2 While Asylum Is Pending: Petition and Adjustment

A person with a pending asylum case may have a potential EB-2 route, but an immigrant petition and eligibility to obtain a green card are separate questions. The pending asylum application does not automatically satisfy EB-2 requirements or remove adjustment-of-status bars. [1] [2]

First establish the employment-based classification

EB-2 generally concerns qualifying advanced-degree professionals and people of exceptional ability under the statute. The ordinary route and the national-interest-waiver route have different requirements. A national-interest waiver does not eliminate the need to establish the underlying classification. [1]

The employer, labor-certification requirements where applicable, petition evidence, and visa availability must all be reviewed. An asylum claim based on persecution does not itself prove an advanced degree, exceptional ability, or eligibility for a waiver.

Then examine how permanent residence could be obtained

Section 245 governs adjustment and contains admission requirements, bars, and exceptions. A pending asylum application is not automatically lawful nonimmigrant status for every adjustment purpose. Work performed with an asylum EAD and maintenance of a separate nonimmigrant classification are also different issues. [2]

Section 245(k) can help qualifying employment-based applicants within its detailed conditions concerning specified violations after the relevant lawful admission. It is not an unlimited exemption for every period out of status or every unauthorized job. Reconstruct admission and employment dates rather than assume a pending case cures the history. [2]

Coordinate the two proceedings without assuming approval

Keep the asylum filing, admission records, work authorizations, employment history, immigrant petition, and any court orders together. Determine who has jurisdiction and whether consular processing or adjustment is legally available. Departure can create separate issues that need review before travel.

For example, an approved I-140 can establish a classification while an adjustment bar remains unresolved. It does not itself authorize a new job or terminate removal proceedings. Likewise, an asylum EAD does not approve the employment-based petition. Do not withdraw a protection claim solely because another petition has been filed without assessing the full route and remaining risks. A useful plan identifies the classification, visa availability, lawful procedure to residence, and continuing obligations in the asylum case. [1] [2]
