A qualifying L-2 spouse can be employment authorized incident to valid L spouse status, without separately obtaining an EAD. L-2 children do not receive that employment authorization simply because they share a dependent visa classification. Status, not the visa foil alone, controls the period of authorized stay. [1][2]
Check the I-94
The admission record should identify the appropriate spouse classification, commonly L-2S. An unexpired record with the qualifying designation can be employment-authorization evidence for Form I-9 together with required identity documentation. If the classification is wrong, seek correction rather than altering the record yourself.
A visa expiration date is not interchangeable with the I-94 expiration date. Review the principal worker’s status and any changes affecting the dependent relationship.
EAD applications and changes
An eligible spouse may choose to request an EAD, but a pending application does not extend the underlying status by itself. After divorce, loss of qualifying status, or an expired admission, do not assume an old card independently preserves unrestricted work permission.
Before starting work, obtain the correct documents and review current official Form I-9 guidance with the employer. If an I-94 amendment or extension is pending, analyze that specific situation rather than treating every L-2 visa holder as automatically authorized.
Example: a visa stamp without a current admission record
A spouse may have an L-2 visa valid for several years but an I-94 with an earlier admitted-until date. The longer visa validity does not by itself extend the spouse’s present status or work authorization. The person should examine the latest admission or approved extension, not rely on the passport sticker alone. [2]
A prospective employer also needs acceptable I-9 evidence, not a general assurance that all L dependents can work. Distinguish the L-2 spouse from an L-2 child and ensure the admission record reflects the appropriate classification.
If the record contains an error, preserve the original and request correction through the issuing agency. Do not change a letter or date in a downloaded PDF. For an expiring admission, plan an extension or another lawful option before the end date and review the consequences of any gap. The employer, employee, and principal worker should be working from the same current documents.
Other dependent categories have different rules, including H-4 EAD eligibility. An incorrect admission record requires the proper I-94 correction process.
