Can You Take FMLA Twice in One Year for Different Reasons?

An eligible employee can use FMLA more than once for different qualifying reasons, but a new reason does not ordinarily create another full12-week entitlement in the same applicable leave year. The usual entitlement is a shared limit across covered reasons, with special rules such as military caregiver leave. [1]

Determine the employer’s leave year

Employers can use different lawful12-month measurement methods under the regulations, including calendar, fixed, forward-measured, or rolling approaches. “This year” therefore does not always mean January through December. Ask which method applies and how the balance was calculated. [2]

Prior continuous and intermittent leave can both affect remaining entitlement. A new diagnosis, surgery, pregnancy-related need, or qualifying family-care event does not automatically erase previously used time.

Military caregiver leave has a separate framework and combined limits in a single12-month period. Do not apply the ordinary formula without checking that category’s rules.

Eligibility and certification still matter

The later request must be for a qualifying reason, and the applicable eligibility and notice rules must be satisfied. A previously approved condition is not proof that every unrelated new absence qualifies. The employer may request appropriate certification under the governing rules.

Intermittent or reduced-schedule leave can be available where the requirements are met, but it is not a guarantee that the employee may choose any schedule without documentation or notice.

Example: surgery followed by family care

An employee uses four weeks for surgery and later requests leave to care for a qualifying parent. If the same applicable leave year continues and no other time was used, the ordinary starting question is the remaining balance, not another automatic twelve weeks. Confirm the actual dates and measurement method before relying on that example.

A rolling method can change the available amount as earlier leave falls outside the lookback period. Ask for a dated accounting rather than assuming the balance stays fixed until a birthday or anniversary.

Review the record

Keep each request, designation notice, certification, work schedule, and employer leave ledger. Identify whether time was properly designated and whether the employer counted the actual time the employee otherwise would have worked.

If the balance is exhausted, assess employer policies, state leave rights, and any ADA obligations separately. Those possible protections are not simply another FMLA allotment. A dispute about the accounting should be raised promptly with supporting records, while the employee continues following lawful reporting and certification requirements.

The certification process is explained in who can complete FMLA paperwork. If no balance remains, review employment and accommodation duties after exhaustion.
