Requesting Removal of an ICE Ankle Monitor

Request a change to an immigration ankle-monitor requirement through the assigned ICE officer and program case manager. Do not remove, disable, or replace the device yourself. Monitoring conditions remain in effect unless the responsible authority changes them. ICE describes ATD supervision as individualized. [1]

Document why a less restrictive method is appropriate

A written request should identify the case, current conditions, compliance history, stable address, upcoming hearings, and the requested alternative. Explain a specific problem such as a documented medical condition, an employment restriction, or a device malfunction. Attach relevant evidence rather than relying on a general request for convenience.

A review interval is not an entitlement

Do not assume that 90 days of compliance automatically requires removal. The program assesses supervision and case-management needs; the decision depends on individual circumstances. An alternative method can still impose reporting and technical requirements. [2]

For example, a clinician’s description of a device-related injury and a proposed alternative gives ICE more concrete information than a statement that the bracelet is uncomfortable.

Follow up without interrupting compliance

Keep the request, attachments, submission date, and response. Report technical or medical problems promptly through the official channels. Continue charging, check-ins, appointments, and other requirements unless instructed otherwise by the responsible authority.

Distinguish the case manager’s role from a changed order

A contractor or case manager can receive information and help communicate a concern, but a favorable conversation is not the same as an authorized change to the release conditions. Ask for written confirmation identifying the effective date and replacement reporting duties. If a medical problem is urgent, report the condition promptly and seek appropriate medical care rather than waiting silently for a routine review. [1] [2]

A request should propose a workable alternative and explain how it addresses compliance concerns. Stable contact information, hearing attendance, and documented reporting history can help the officer understand the request, but none guarantees approval. If the bracelet malfunctions, preserve the report and instructions rather than letting the failure appear as an unexplained missed check-in. Continue distinguishing technical troubleshooting from permission to stop monitoring.

Counsel can help seek review of an unresolved request and explain the effect of any court or release order. See stays of removal and ICE arrest authority. A pending monitor-change request does not itself stop removal or eliminate other release conditions.
