You may be able to receive vacation pay while on disability, but whether it changes another payment depends on the program. SSDI, SSI, employer disability insurance, paid leave, and FMLA do not use one common rule. Identify both the source of the vacation money and the benefit you receive.
SSDI: separate pay from actual work
SSA’s work-evaluation guidance distinguishes pay earned through actual work from vacation, sick, holiday, or disability pay for time not worked. A payment for unused vacation does not necessarily show substantial gainful activity in the month the check arrives. Documentation should explain what period and activity produced it. [1]
For example, an employer’s payout of leave accrued before disability is different from wages for returning to work during the same month. A payroll total that combines both amounts may require a breakdown before SSA can evaluate the work properly.
SSI: the financial payment still matters
SSI evaluates income and resources under its own rules. Vacation pay can count even where it does not represent current productive work for SSDI purposes. Timing, exclusions, and retained funds need review. Report the payment rather than assuming an SSDI work rule also excludes it from SSI. [2]
Employer plans and FMLA
A private short-term or long-term disability policy may offset other pay or limit concurrent payments. The employer’s vacation policy and applicable state law determine whether leave can be used or cashed out. Ask for the actual policy language, not only an informal payroll estimate.
FMLA generally concerns job-protected leave, rather than a separate disability check. Rules governing substitution of accrued paid leave and coordination with disability benefits require their own analysis. Payment approval does not necessarily extend protected leave or authorize additional absences.
Before accepting a payout
- Ask payroll for the accrued period, hours, and payment description.
- Request the disability plan’s offset and reporting provisions.
- Report the payment to SSA if required for your benefit.
- Keep the gross and net amounts and any repayment calculation.
See FMLA running with short-term disability for leave coordination. self-employment while receiving disability addresses a different income source. If an administrator reduces benefits, request the written reason and calculation before concluding that every vacation payment must cause the same result.
